Hi,
1. It is clear that a faulty front door needs to be repaired. This a common element that is the Association’s responsibility to maintain.
(In a separate email, Rupert opined: "I also think that if EMTs have to break in to a unit in an emergency, the cost of door replacement should be the owner's responsibility.” I agree and suggest we add this to the rules, perhaps in the “Keys” section. This also brings up the topic of inspecting units when they are being sold to make sure there isn’t any damage the selling owner needs to pay for.)
2. As I was editing the Rules and Regulations in preparation for upcoming the R & R Committee meeting, it occurred to me to see if there are currently any rules about door changes. I think there is one.
The Sixth Amendment to our CC&Rs, Section 4.7.2 says “A Unit Owner…. may not change the appearance of the Common Elements or the exterior appearance of a Unit without permission of the Association.”
Ordinarily, repairing/replacing as we do with windows is not seen as “changing the exterior appearance” of a unit because the windows guys use windows that have approved designs, even though they are not the same as the original wooden window frames.
In the case of Unit 1207’s front door, the most conservative approach is “like for like”…. that is replace it with something that is as much like the current one as possible. We’ve been told that the same doors are no longer being made. However, we could probably find something close. Another factor is that our front doors all have either one or two sidelights, which I believe are all part of a single pre-hung door unit. A replacement might also need to be a pre-hung unit, rather than a single door.
3. Changing the appearance/design of a front door is a change to the present architectural aesthetic of our community. If other owners also choose to do so, we could face decisions about what designs to approve etc. I think this is a topic best addressed by the Architectural Committee, except that I don’t think we really have one. Perhaps we should call together an ad hoc committee to address this issue.
